§ 1 Name and Domicile
1.1. The fan club is called „Lost In Devotion - International Nightwish Fan Club"
(subsequently INWFC).
1.2. Its domicile is situated in 22307 Hamburg, Germany. It can be misplaced by the board of directors.

§ 2 Purpose
2.1. Purposes are
2.2. The fan club is not obliged to a certain group or party.

- To support the intercultural communication of Nightwish fans of all nationalities and to create a global network that enables cross-national communication.
- To establish a platform that provides an high amount of information concerning the band and supports the fans with contacting like-minded people, especially in countries where the band is not that famous yet.
- To enhance the awareness level of the band with the points mentioned above
2.2. The fan club is not obliged to a certain group or party.
§ 3 Selflessness
3.1. The Fan Club is predominantly a non profit organisation and acts in a selfless manner.
3.2. No person/member may be benefited by disproportional remunerations or expenditures that do not fit the purposes of the INWFC.

§ 4 Membership
4.1. Every full- or under aged legal person may become a member of the INWFC.
4.2. A member is affiliated by filling out an online application form. The affiliation is confirmed by an e-mail of the chairwoman.
4.3. The membership begins with the payment of the admission fee.
4.4. The membership ends with death, voluntarily leaving or the exclusion of the INWFC because of an important reason. Leaving the fan club voluntarily is possible at any time. A notice in writing (letter, fax, e-mail) is needed. The admission fee or any other payments won‘t be paid back in any case.
4.5. Important reasons for an exclusion of the INWFC are:

- Violation of this constitution, ordinances and interests of the fan club as well as valid texts of law
- Also a non tolerable or rather rude and unethical behavior that endamages the fan club may cause an exclusion

§ 5 Membership Fees
There are no annual fees at all, only an admission fee of € 5,00 is charged. In case of financial difficulties, there is the possibility of being excused from the admission fee by the board of directors.

§ 7 Board of Directors
7.1. The board of directors represents and manages the INWFC (unsalaried).
7.2. Members of the board of directors occupy the same right to cancel than every other full member. The particular office can be resigned without any reasons at any time. The remaining members of the board of directors decide about a possible alternative to the former member.
7.3. In case of the death of the chairwoman, the deputy chairperson will adopt all authorizations and responsibilities.

9.1. They manage a city or a certain area in the particular state and represent the interests of the board of directors, country managers and members there.

§ 10 Privacy
10.1. The INWFC records a variety of personal details of its members. These information will be saved in the data processing system of the chairwoman. At the same time a membership number is assigned to every member of the fan club. The personal details are protected against cognition of third by appropriate technological appliance.
10.2. Publication of member related data/membership roster
The INWFC publishes photos and other information of its board of directors, managers and supporters at www.inwfc.com. In addition, a publication of names or other information about fan club members (e.g. in the context of the fan club magazine or distribution of the membership roster in the member area) may be possible. Every member has the right to disagree with individual related publications at every time.
10.3. In case of the withdrawal of the fan club, individual related data of the particular member will be removed from the membership roster and the data processing system of the chairwoman.
